Non-Discrimination Policy
Access America Prep Programs LLC “AAPP” admits students of any race, color, national and ethnic origin to all the rights, privileges, programs, and activities generally accorded or made available to students in our programs. AAPP does not discriminate on the basis of race, color, national and ethnic origin in administration of its program policies, admissions policies, or any AAPP-administered programs.
Disclaimer
I declare that the information reported on the application is true and complete. I understand that the continued enrollment of the applicant after admission will be contingent upon the completeness and accuracy of these statements.
WAIVER OF ACCESS: All rights of access conferred by the Family Educational Rights and Privacy Act of 1974 (P.L. 93-80) as amended, or otherwise, to all information and materials of any kind received by AAPP from any source in connection with the application for admission, including this application, are hereby waived.
Confidentiality: Our interpretation of the significant features of the Buckley Amendment:
1. Applicants and their families do not have access to their admissions files during the application process.
2. Non-matriculated, waiting list, and rejected applicants and their families do not have access to their files.
3. Matriculated students and their parents do not have access to their files if they have signed the above waiver.
Parent/Legal Guardian Agreement
Parent has read the AAPP brochure and hereby gives permission for parent’s child/ward to participate in the AAPP program during the summer of 2011 at Wesleyan University. By execution of the application and this Agreement, parent confirms awareness and acknowledges the risks of injury which may be associated with travel, particularly in foreign countries. Parent’s child/ward is enthusiastic and prepared, and parent believes he/she is capable of handling both the emotional and physical aspects of the program as well as any risks involved.
Right to Terminate Enrollment/Rules and Regulations Parent acknowledges and agrees that AAPP has the right to suspend or terminate the enrollment of any Student at any time at its sole discretion. Reasons for such suspension or termination include but are not limited to: (i) Student disregards or does not abide by the Rules and Regulations of AAPP or the instructions of an AAPP staff member; (ii) a Parent, guardian, or other individual closely associated with the Student fails to cooperate with AAPP or disregards or does not abide by the rules and regulations of AAPP; (iii) AAPP determines that the continued attendance of a Student in an AAPP program is not in the best interests of the Student or AAPP; (iv) AAPP determines that continued involvement of a Parent or guardian with AAPP is not in the best interest of the Student or AAPP; or (v) other reasons as determined in the sole discretion of AAPP.
Parent agrees that AAPP shall have no further responsibility for my child/ward upon his/her dismissal from the program, and Parent understands that such dismissal may occur at a location far from the child/ward’s home. Parent affirms that AAPP shall have the exclusive authority to determine the manner and means of transporting my child/ward home without supervision, and that all additional expenses (including but not limited to the entire costs of the transportation) shall be borne completely by Parent, and that AAPP shall have no obligation to provide any refund of the tuition fee with respect to any dismissed student. Prior to the commencement of the program, Parent agrees to sign a credit card authorization to be held by AAPP authorizing the payment from parent credit card of any such expenses of parent’s child/ward in the event of the dismissal of parent’s child/ward.
Student Likeness AAPP often takes photographs during campus tour programs. By signing this Contract, Student and Parent agree that AAPP may use Student's name, portrait or likeness in connection with AAPP activities or publicizing AAPP, and that, except as prohibited by law, AAPP may use Student's information and records at AAPP's sole discretion
Consent to share By signing this Contract, Student and Parent agree that AAPP may share Student's personal details and contact information with other AAP program participants.
General Release Agreement Parent recognizes that travel can be a dangerous activity involving many risks of injury. Parent understands that AAPP is not an insurer of the health or safety of Student and does not assume responsibility for spontaneous and unforeseen events which may occur during Student's participation in the program. Parent authorizes AAPP, at its sole discretion, to place parent’s child/ward at parent’s own expense and without any further consent or advance notice in a hospital for medical services and treatment or, if no hospital is readily available, to place parent’s child/ward in the care of a licensed medical doctor for treatment. Parent hereby grants AAPP full authority to take whatever actions it may reasonably consider to be warranted under the circumstances.
Parent acknowledges that Student is expected to adhere to all AAPP's rules and instructions, as well as the direction of the program staff. Furthermore, AAPP is not responsible for supervising Student, and the Student will at times be UNSUPERVISED. Additionally, Students will be staying on a campus or in hotels which are not run by AAPP. AAPP cannot be responsible for the safety, maintenance, or upkeep of the facilities, including, but not limited to, hotel swimming pools, hot tubs, Jacuzzis, saunas, or gyms (including cardiovascular equipment and free weights) at each hotel. Students using these facilities do so at their own risk.
Parent and student release and hold harmless AAPP, its agents and employees from all claims, damages and other liability for injury to Student where such claims, damages or other liability are not the result of intentional conduct or gross negligence by AAPP, its agents or employees. Parent and Student understand that as a result of executing this release, Parent and Student will be forever barred from suing AAPP as a result of Student's enrollment or participation in the program.
Choice of Law and Venue This Contract shall be governed by the laws of the State of New York, without giving effect to the principles of conflicts of law. All disputes arising out of or related to this Contract shall be submitted to the state and federal courts of New York, and each party irrevocably consents to such personal jurisdiction and waives all objections thereto, but does so only for the purposes of this Contract.
Attorneys Fees In the event that AAPP prevails in any action to enforce this Contract, Parent shall pay the costs and expenses, including reasonable attorney's fees, which AAPP incurs.
